Platform Policy & Liability

Kashana Rental Services operates solely as a technology platform that connects vehicle owners/vendors with customers who need a vehicle. Kashana Rental Services does not own the vehicles listed on the platform, does not operate, maintain, inspect, or control them, and is not a party to the agreement between the vendor and the customer. It acts as an intermediary that connects customers with companies.

All responsibility regarding vehicle condition, roadworthiness, official permits, registration, maintenance, pricing accuracy, vehicle availability, accidents, damages, traffic violations, disputes, injuries, losses, or legal obligations rests solely with the vendor and/or the customer in the rental transaction, and Kashana Rental Services bears no responsibility of any kind.

Kashana Rental Services shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the rental, use, or operation of any vehicle listed on the platform.

Vendors are solely responsible for ensuring that their vehicles comply with all applicable laws, regulations, requirements, and safety standards.

Please read these Terms and Conditions carefully before reserving any vehicle through Kashana Rental Services. By completing a reservation, you agree to be bound by these terms.

1. Platform Role

Kashana Rental Services (“Kashana”) operates solely as a technology platform that connects vehicle owners/vendors (“Vendors”) with customers seeking to rent a vehicle (“Renters”). Kashana does not own, operate, maintain, or inspect the vehicles listed on the platform, and is not a party to the rental agreement between the Vendor and the Renter.

2. Responsibilities

All responsibility regarding vehicle condition, roadworthiness, permits, registration, maintenance, pricing accuracy, vehicle availability, accidents, damages, traffic violations, disputes, injuries, losses, or legal obligations rests solely with the Vendor and/or the Renter. Kashana shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the rental, use, or operation of any vehicle listed on the platform.

3. Rental Agreement

By reserving a vehicle through Kashana, you enter into a rental agreement directly with the Vendor offering that vehicle. That agreement, together with these Terms and Conditions, governs your rental.

4. Eligibility Requirements

Renters must be at least 20 years of age and hold a valid driving licence. An International Driving Permit is required for renters who do not hold a local licence.

5. Account Creation & Identity Verification

Everyone who makes a reservation needs a Kashana account — if you do not have one, starting a reservation automatically creates one using the name, phone, and email you provide, and a verification code is sent to your email. To continue, you must upload a copy of your Tazkira (front and back) and a recent electricity bill as proof of address. Before the vehicle is handed over, you must visit a Kashana office in person with your original Tazkira and original electricity bill so that staff can verify them against the copies you uploaded. This requirement is the same for everyone who makes a reservation and is never waived.

6. Bookings From Outside Afghanistan

If you are booking from outside Afghanistan, you upload a copy of your passport instead of a Tazkira and electricity bill, and you then contact Kashana directly — Kashana will arrange the booking with you. Your reservation is still a real booking and the vehicle is held for you. Identity verification is still required and is completed with Kashana before the vehicle is handed over.

7. Reservation & Payment

A reservation passes through a verification stage before payment is handed over. In connection with the rental, an amount is collected as a security deposit, which is released (refunded) after the vehicle is returned and subject to the Vendor inspecting its condition and finding no damage.

8. Payment Disputes

Disputes over charges, deposit deductions, or refund amounts relating to a specific rental are between the Vendor and the Renter, since Kashana is not a party to the rental agreement. Kashana may assist in facilitating communication between the parties, but is not obliged to mediate, reverse a Vendor’s charge, or pay compensation. Disputes relating to platform fees or to Kashana’s own services (where applicable) must be raised directly with Kashana support.

9. Vehicle Use

Vehicles may only be driven by the registered Renter or by approved drivers. Off-road use, racing, sub-renting, and use for commercial transport — whether licensed or unlicensed — are strictly prohibited. All responsibility rests with the Renter, who is liable for all traffic violations and fines incurred during the rental period.

10. Vendor Responsibility

Vendors are solely responsible for ensuring that their vehicles comply with all applicable laws, regulations, and safety standards; and that their vehicles are roadworthy, properly registered, and accurately described and priced on the platform.

11. Customer Responsibility

Renters are solely responsible for driving the rented vehicle safely and lawfully, for any damage, traffic violation, or fine incurred during the rental period, for returning the vehicle in the same condition in which it was received (normal wear and tear excepted), and for the accuracy of the information and documents they provide.

12. Fraud Prevention

Submitting forged identity documents, impersonating another person, or providing fraudulent payment information is strictly prohibited and may result in immediate account suspension, cancellation of the reservation, and referral to the legal authorities. The identity verification process described in Section 5 exists specifically to protect Vendors and Renters from fraud.

13. Communication Through Kashana

To protect both parties, all communication between Vendors and Renters relating to a reservation must take place through Kashana. Direct contact details are not shared between Vendors and Renters. If you need to contact the other party, please contact Kashana support.

14. Disputes & Cancellation Policy

Cancellations made more than 24 hours before the scheduled handover time are fully refunded. A cancellation within 24 hours may incur a one-day rental charge. A no-show may be charged the full rental amount. Kashana reserves the right to cancel a reservation due to vehicle unavailability, with a full refund. Disputes about whether a cancellation charge was applied fairly should be raised with Kashana support, who will review the reservation timeline.

15. Late Returns

Vehicles must be returned at the agreed time and place. A late return may be charged at the standard hourly rate. A delay of more than 2 hours without prior notice may be treated as an unauthorised extension.

16. Governing Law

These Terms and Conditions are governed by the laws of Afghanistan. Disputes relating to Kashana’s platform services (as distinct from disputes between Vendor and Renter, covered under Sections 1–2) shall first be resolved through good-faith negotiation.
